Terms and Community Guidelines

1. Eligibility

You must be at least 18 years old to use Vouched. By using Vouched, you represent that you are 18 or older, can form a binding agreement, and are not barred from using the service by law or by a prior suspension or removal from Vouched.

You are responsible for providing accurate account information and keeping your account secure. Do not share your login credentials or use someone else's account.

Age Verification Disclaimer. Vouched does not independently verify the age of every user. If you provide false information about your age to gain access to Vouched, you bear sole responsibility for any harm, legal claim, or liability that results. Vouched will immediately terminate any account discovered to belong to a person under 18 and will cooperate with law enforcement where required. If you encounter a user you believe to be a minor, report them immediately in the app or at safety@gotvouched.com.

2. What Vouched Is

Vouched helps adults create dating profiles with friend endorsements, discover other members, express romantic or friendship interest, match, chat, and plan in-person dates or events. Vouched does not guarantee matches, dates, relationship outcomes, compatibility, user conduct, identity, background-check results, safety, or event attendance.

3. User Content

"User Content" means anything you submit, upload, create, send, record, or make available through Vouched, including profile text, photos, Live Photos, videos, voice responses, transcripts, vouches, endorsements, messages, date-planning content, reports, feedback, and invite information.

You keep ownership of your User Content, but you grant Vouched a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, modify, create derivative works from, distribute, and otherwise use your User Content as needed to operate, improve, promote, secure, and support Vouched. This includes generating or displaying montages, summaries, vouch highlights, profile content, and safety or moderation materials.

You are responsible for your User Content and must have the rights and permissions needed to submit it. Do not submit content that violates another person's rights, privacy, publicity, intellectual property, or safety.

4. Vouches and Endorsements

Vouches should be honest, respectful, and based on your real relationship with the person. Do not impersonate someone, submit fake endorsements, manipulate the vouch process, pressure someone to vouch, or disclose private information that the person has not consented to share.

Vouched may let a member select, hide, restore, summarize, or display portions of vouches on their profile. We may remove vouch content that appears abusive, false, unsafe, illegal, infringing, or inconsistent with these Terms.

5. Community and Safety Guidelines

Vouched is for respectful adult dating and social connection. You agree not to:

• Harass, bully, threaten, stalk, shame, exploit, or intimidate another person.
• Post hateful, discriminatory, defamatory, sexually explicit, pornographic, violent, graphic, or illegal content.
• Use Vouched for prostitution, trafficking, coercion, extortion, blackmail, scams, spam, commercial solicitation, or unlawful activity.
• Share another person's private information, photos, messages, contact details, location, or identity documents without permission.
• Impersonate another person, misrepresent your identity, age, relationship status, intentions, background, or qualifications.
• Create fake accounts, automate activity, scrape data, reverse engineer the app, interfere with security, or attempt unauthorized access.
• Use Vouched to contact people who have blocked you, unmatched, asked you to stop, or otherwise withdrawn consent.
• Encourage self-harm, violence, dangerous conduct, or illegal behavior.
• Send, share, or solicit sexually explicit images, videos, or content — including unsolicited "nude" or genital imagery — to any user without their explicit, affirmative prior consent. The sender of unsolicited explicit content bears full personal and legal liability for any resulting claim, and such conduct is grounds for immediate account termination and referral to law enforcement.
• Use Vouched to advertise, solicit, facilitate, or promote prostitution, commercial sexual services, or any form of human trafficking.

6. Reporting, Blocking, and Moderation

You can block users and report safety concerns in the app. You can also contact safety@gotvouched.com. We may review reports, user content, account activity, and related information to enforce these Terms and protect users.

We may remove content, limit visibility, issue warnings, disable features, suspend or terminate accounts, preserve evidence, contact affected users, or cooperate with law enforcement where appropriate. We are not obligated to monitor all content before it appears, and moderation decisions may involve judgment calls.

7. Dating, In-Person Meetings, and Events

You are responsible for your interactions with other users, including in-person dates and events. Use good judgment, meet in public when appropriate, tell someone you trust where you are going, arrange your own transportation, and report unsafe behavior. Vouched does not control users' offline conduct.

If Vouched offers events, event access may be limited, changed, canceled, or subject to additional rules. You are responsible for your own safety, behavior, transportation, purchases, and compliance with venue rules and law.

8. Verification and Background-Check Features

If identity verification, background checks, credit checks, badges, or verified pools are available, they are optional tools to support trust, not requirements for using the core dating service and not guarantees of safety, character, future behavior, compatibility, financial status, or complete criminal history. Availability, criteria, data sources, timing, and results may vary. We may remove or change verification features at any time.

9. AI Features and Third-Party AI Providers

Vouched uses artificial intelligence and machine learning to power features including: audio transcription, voice interview assistance, vouch and profile summarization, content generation, match recommendations, and moderation and safety workflows. Some of these capabilities are powered by third-party AI service providers, which may include OpenAI and other vendors. When you use AI-powered features — including but not limited to voice recording, audio uploads, or interview participation — your audio, voice data, and related content may be transmitted to and processed by these third-party providers in order to deliver the feature.

By using any AI-powered feature, you:

• Consent to the transmission of your audio, voice, and content data to third-party AI providers as described above and in our Privacy Policy.
• Acknowledge that AI outputs — including transcripts, summaries, and generated content — may be incomplete, inaccurate, biased, or inappropriate, and that Vouched does not warrant the accuracy or fitness of any AI-generated output.
• Agree that you are solely responsible for reviewing any AI-generated profile content, vouch summaries, or other outputs before publishing or relying on them.
• Acknowledge that Vouched is not liable for any harm, misrepresentation, embarrassment, data loss, or other injury resulting from AI-generated content, transcription errors, or the processing of your data by third-party AI providers.

Vouched's use of third-party AI providers is subject to those providers' own terms and privacy policies, which are independent of Vouched. We do not control third-party providers' data practices beyond our contractual obligations with them. Vouched reserves the right to change, add, or remove AI providers or features at any time without notice.

10. Privacy

Our Privacy Policy explains how we collect, use, share, and retain information. By using Vouched, you agree that we may process information as described in the Privacy Policy. Review it at gotvouched.com/legal/privacy.

11. Notifications and Communications

We may send service messages, verification codes, safety messages, support replies, invitations, and app notifications. You can manage push notifications in the app or your device settings.

SMS / Text Messaging Consent. By providing your mobile phone number to Vouched and checking the consent box during registration or account setup, you expressly consent to receive recurring automated text messages (SMS/MMS) from Vouched at the mobile number you provide. These messages may include: account verification codes, security alerts, match and activity notifications, event reminders, safety information, and service announcements.

• Opt-in: Consent is collected at account registration when you enter your phone number and affirmatively agree to receive text messages. Consent is not a condition of creating an account or using Vouched.
• Message frequency: Message frequency varies based on your account activity and preferences.
• Rates: Message and data rates may apply. You are responsible for any charges from your mobile carrier.
• Opt-out: You may opt out of text messages at any time by replying STOP to any Vouched text message. After opting out, you will receive a single confirmation message and no further texts (except as required for account security, such as critical safety alerts you cannot disable).
• Help: Reply HELP to any Vouched text message or email hello@gotvouched.com for assistance.
• Carriers: Wireless carriers (e.g., AT&T, T-Mobile, Verizon) are not liable for delayed or undelivered messages.

By providing your phone number you represent that you are the account holder or have authorization to consent on behalf of the account holder for that number. Vouched retains records of your consent, including the date, time, phone number, and method of opt-in, as required by applicable law.

12. Payments and Auto-Renewal Disclosure

Vouched may offer free and paid features in the future. If paid digital features are offered in the iOS app, they will be handled through Apple's in-app purchase system where required. Any paid feature will be described before purchase and may be subject to additional terms.

Auto-Renewal. If Vouched introduces automatically renewing subscriptions, the following will be clearly disclosed at the point of purchase before any charge is incurred: (a) the subscription period (e.g., monthly or annual); (b) the recurring charge amount and currency; (c) the date on which the next charge will occur; and (d) how to cancel before renewal to avoid the next charge. Subscriptions will renew automatically at the end of each period unless cancelled in advance through your account settings or the applicable app store. Cancellation instructions will be provided at the time of purchase and within your account settings. You are responsible for cancelling before the renewal date if you do not wish to be charged. Vouched does not provide refunds for partial subscription periods except where required by law.

13. Intellectual Property

Vouched, our branding, software, design, text, graphics, logos, and other materials are owned by Vouched Inc. or our licensors. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from our service except as allowed by law or with our written permission.

14. Termination

You may stop using Vouched at any time and may delete your account in the app. We may suspend or terminate your account, remove content, or restrict access if we believe you violated these Terms, created risk, caused harm, or used the service unlawfully.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOUCHED IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

VOUCHED INC. EXPRESSLY DISCLAIMS ALL WARRANTIES AND REPRESENTATIONS REGARDING:

• The identity, age, intentions, character, background, mental or physical health, criminal history, or conduct of any user, whether on or off the platform.
• The accuracy, completeness, or reliability of any user-submitted profile information, photos, vouches, or endorsements.
• The accuracy, completeness, or reliability of any background check, identity verification, or verified pool membership.
• The accuracy, fitness, or suitability of any AI-generated output, transcript, summary, or recommendation.
• Matches, romantic compatibility, relationship outcomes, dates, or the suitability of any user as a romantic or social partner.
• The safety of any in-person meeting, date, or event arranged through or facilitated by Vouched.
• The availability, reliability, continuity, or security of the service or any feature.

VOUCHED IS A PLATFORM THAT CONNECTS USERS — IT IS NOT A BACKGROUND-CHECK SERVICE, A DATING AGENCY, A SAFETY GUARANTOR, OR A MENTAL HEALTH OR CRISIS SERVICE. YOU USE VOUCHED AT YOUR OWN RISK AND ASSUME ALL RISK ARISING FROM YOUR INTERACTIONS WITH OTHER USERS, WHETHER THOSE INTERACTIONS OCCUR ON OR OFF THE PLATFORM.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOUCHED INC. AND ITS PARENT, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, AND AGENTS (COLLECTIVELY, "VOUCHED PARTIES") SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind;
• Loss of profits, revenue, data, goodwill, or business opportunities;
• Personal injury, emotional distress, psychological harm, physical harm, or death arising from or related to your use of Vouched or your interactions with any other user;
• The conduct, statements, actions, or omissions of any user of Vouched, whether on or off the platform;
• Any content submitted by users, including profile information, vouches, photos, messages, or AI-assisted content;
• Inaccuracies in background checks, verifications, or any information provided by third-party data sources;
• Errors, inaccuracies, or omissions in any AI-generated transcript, summary, or output;
• Unauthorized access to or alteration of your account, data, or communications;
• Any event, interaction, or harm occurring off the Vouched platform, including in-person dates, meetups, or events.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF THE VOUCHED PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF VOUCHED EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO VOUCHED IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). THIS LIMITATION APPLIES REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND EVEN IF A VOUCHED PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

17. Assumption of Risk and Release of Claims

You voluntarily use Vouched with full knowledge that meeting strangers — whether through a dating application or otherwise — carries inherent risks, including but not limited to the risk of physical harm, emotional harm, financial loss, sexual assault, harassment, stalking, fraud, and death. Vouched is not able to screen every user or predict every user's behavior. Background checks and verification features, where available, are not complete or infallible.

BY USING VOUCHED AND MEETING OTHER USERS IN PERSON OR COMMUNICATING WITH THEM ON OR OFF THE PLATFORM, YOU VOLUNTARILY AND KNOWINGLY ASSUME ALL RISKS ASSOCIATED WITH THOSE INTERACTIONS, INCLUDING ALL RISKS OF PHYSICAL HARM, EMOTIONAL HARM, PROPERTY DAMAGE, AND FINANCIAL LOSS.

To the fullest extent permitted by law, you hereby release, waive, and forever discharge Vouched Inc. and all Vouched Parties from any and all claims, demands, damages, costs, expenses, liabilities, and causes of action of every kind and nature — known and unknown — arising out of or in connection with:

• Any interaction with another Vouched user, whether on the platform or off it, including but not limited to in-person dates, phone calls, text messages, social media contact, or physical meetings;
• Any harm caused by another user's conduct, misrepresentation, fraud, assault, harassment, stalking, or any other tortious or criminal act;
• Any reliance on another user's profile, photos, vouches, endorsements, or background-check badge;
• Any AI-generated transcript, summary, recommendation, or content that proves inaccurate, misleading, or harmful;
• Any event hosted, facilitated, or promoted by Vouched.

If you are a California resident, you waive the protections of California Civil Code § 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." You expressly intend each element of the release above to cover unknown claims.

18. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend (at Vouched's option), and hold harmless Vouched Inc. and all Vouched Parties from and against any and all claims, demands, suits, proceedings, liabilities, damages, losses, fines, penalties, costs, and expenses — including reasonable attorneys' fees — arising out of or related to:

• Your use of Vouched or any feature thereof;
• Your User Content or any vouch or endorsement you submit;
• Your interactions with any other user, whether on or off the platform;
• Your violation of these Terms or any applicable law, regulation, or third-party right;
• Any misrepresentation you make about your identity, age, relationship status, intentions, or qualifications;
• Any harm you cause to another user or third party in connection with your use of Vouched.

Vouched reserves the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification. You may not settle any claim without Vouched's prior written consent.

19. Dispute Resolution, Arbitration, and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Informal Resolution. Before filing any formal dispute, you agree to contact Vouched at legal@gotvouched.com and attempt to resolve the dispute informally for at least thirty (30) days.

Binding Arbitration. If the dispute is not resolved informally, you and Vouched agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of Vouched — including disputes about AI features, user interactions, background checks, events, or any harm caused by another user — shall be resolved by final and binding individual arbitration. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. Judgment on the arbitration award may be entered in any court of competent jurisdiction. The arbitration shall take place in Austin, Texas, or, at your election, remotely.

CLASS ACTION AND JURY TRIAL WAIVER. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT, CLASS-WIDE ARBITRATION, PRIVATE ATTORNEY GENERAL ACTION, OR ANY OTHER REPRESENTATIVE PROCEEDING. YOU ALSO WAIVE YOUR RIGHT TO A JURY TRIAL. ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY.

Exceptions. Either party may bring an individual claim in small claims court. Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

Governing Law. These Terms and any disputes arising hereunder are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where federal law applies.

20. Anti-Trafficking and FOSTA-SESTA Compliance

Vouched strictly complies with the Allow States and Victims to Fight Online Sex Trafficking Act (FOSTA-SESTA, Pub. L. 115-164) and all applicable federal and state anti-trafficking laws. Vouched expressly prohibits using the platform to advertise, solicit, facilitate, or promote prostitution, sex trafficking, or any commercial sexual exploitation.

You may not use Vouched to recruit, harbor, transport, provide, obtain, maintain, patronize, solicit, or benefit financially from the sex trafficking of any person. Any content that promotes, facilitates, or supports human trafficking is strictly prohibited and will be removed immediately.

Vouched will preserve all relevant evidence and cooperate fully with law enforcement and civil authorities in connection with any trafficking-related activity. Accounts involved in trafficking-related conduct will be immediately terminated and reported to the National Human Trafficking Hotline (1-888-373-7888) and applicable law enforcement. Vouched reserves all rights and remedies available under FOSTA-SESTA and related statutes.

21. Child Safety and CSAM

Vouched has zero tolerance for child sexual abuse material (CSAM) or any content that sexually exploits, grooms, solicits, or endangers minors. This prohibition applies to all content submitted to Vouched, regardless of format.

Any user who uploads, transmits, shares, or distributes CSAM will be immediately banned, reported to the National Center for Missing and Exploited Children (NCMEC) CyberTipline as required by 18 U.S.C. § 2258A, and reported to applicable law enforcement agencies. Vouched will preserve all associated account data and cooperate fully with all resulting investigations and prosecutions.

If you encounter CSAM or any suspected exploitation of a minor on Vouched, report it immediately: (a) in the app using the report feature; (b) by emailing safety@gotvouched.com; and (c) directly to the NCMEC CyberTipline at missingkids.org/gethelpnow/cybertipline or by calling 1-800-843-5678.

22. Biometric and Photo Data

Certain features — including identity verification, photo submission, and video profiles — may involve the collection of facial imagery or biometric identifiers such as facial geometry. If you are a resident of Illinois, Texas, Washington, or another state or jurisdiction with biometric privacy laws (including the Illinois Biometric Information Privacy Act (BIPA), 740 ILCS 14, or Texas Business & Commerce Code § 503.001), the following applies:

By submitting photos or videos that may include your facial geometry for verification or profile purposes, you expressly consent to Vouched and its verification service providers collecting, storing, and using such biometric data solely to provide and improve identity verification and safety features. Vouched will not sell biometric data. Biometric data will not be disclosed to third parties except as necessary to provide verification services or as required by applicable law.

Vouched will retain biometric identifiers and biometric information only as long as necessary for the purpose collected or as required by law, and will destroy such data within three (3) years of your last interaction with the platform or upon account deletion, whichever comes first, unless a longer retention period is required by law.

Vouched does not provide crisis counseling or emergency services. If you are in immediate danger, call 911.

24. General Provisions

Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will continue in full force and effect.

Entire Agreement. These Terms, together with the Privacy Policy and any additional terms or policies incorporated by reference, constitute the entire agreement between you and Vouched regarding your use of the service and supersede all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral.

No Waiver. Vouched's failure or delay in enforcing any right or provision of these Terms does not constitute a waiver of that right or provision. A waiver in one instance does not operate as a waiver of any future breach or default.

No Agency. Nothing in these Terms creates an agency, partnership, joint venture, employment, or franchise relationship between you and Vouched. You have no authority to bind Vouched in any way.

Assignment. You may not assign or transfer any of your rights or obligations under these Terms without Vouched's prior written consent. Vouched may assign its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

Survival. The following sections survive expiration or termination of these Terms for any reason: Sections 3 (User Content), 15 (Disclaimers), 16 (Limitation of Liability), 17 (Assumption of Risk and Release), 18 (Indemnification), 19 (Dispute Resolution), and 24 (General Provisions).

25. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date and may provide additional notice. Your continued use of Vouched after changes become effective means you accept the updated Terms.
